Terms of Service

These Terms of Service ("Terms") govern your use of KhodiStays, operated by KhodiStays Ltd ("KhodiStays", "we", "us"), a company registered in Kenya. By creating an account, listing a property, or otherwise using KhodiStays, you agree to these Terms. If you do not agree, please do not use the platform.

1. What KhodiStays Is

KhodiStays is a listings and discovery platform. We give property owners a place to publish their properties and give guests a place to find and view them. We are not a booking agent, travel agency, or payment processor, and we are not a party to any rental, booking, or payment arrangement made between a guest and a property owner. We do not broker, negotiate, guarantee, or take a cut of any transaction between users.

2. Eligibility

You must be at least 18 years old to create an account or use KhodiStays.

3. Accounts

You're responsible for the accuracy of the information you provide and for keeping your account credentials secure. You're responsible for all activity that happens under your account.

4. Property Listings

Property owners are solely responsible for the accuracy of their listings — including descriptions, photos, pricing, availability, and their legal right to list and rent out the property. KhodiStays does not inspect, verify, or guarantee the condition, legality, or existence of any listed property.

5. Bookings & Payments

KhodiStays does not process, hold, or have visibility into any payments between guests and property owners. Any payment method, amount, deposit, or timing is agreed directly between the guest and the property owner, entirely outside of KhodiStays. We are not responsible for, and have no liability arising from, non-payment, fraud, disputes, property condition, or any other matter arising from a booking or payment arrangement between users.

6. Cancellations & Refunds

Each listing displays a cancellation policy set by the property owner. This policy — and any refund arising from it — is between you and the property owner. KhodiStays displays the stated policy as a courtesy but does not enforce it, guarantee it, or mediate disputes about it, since we are not involved in the underlying payment.

7. Listing Fees

Publishing a property listing on KhodiStays costs KES 200 per month per property. This fee is currently discounted 100% (i.e. free) during our launch period while we finalize subscription billing; we'll give notice before that changes. We do not charge any commission or fee on bookings themselves.

8. Acceptable Use

You agree not to use KhodiStays to: post fraudulent, misleading, or illegal listings; harass or misrepresent yourself to another user; scrape or bulk-extract data from the platform; or infringe on anyone's intellectual property or legal rights.

9. Content You Submit

You retain ownership of the listing content, photos, and descriptions you submit. By submitting it, you grant KhodiStays a license to host, display, and promote it on the platform for as long as your listing is active.

10. Disclaimers & Limitation of Liability

KhodiStays is provided "as is", without warranty of any kind. We don't guarantee listing accuracy, property availability or condition, or that any booking will be successfully arranged. To the maximum extent permitted by Kenyan law, KhodiStays is not liable for any loss or damage arising from your use of the platform, or from any interaction, booking, or payment between users, since we are not a party to it.

11. Suspension & Termination

We may suspend or remove any account or listing that violates these Terms, at our discretion.

12. Governing Law

These Terms are governed by the laws of Kenya, and any disputes will be subject to the exclusive jurisdiction of the courts of Nairobi, Kenya.

13. Changes to These Terms

We may update these Terms from time to time. Continued use of KhodiStays after a change means you accept the updated Terms.
